Miller Starr Regalia’s Product Liability Group offers extensive experience in counseling and defense, particularly for manufacturers, developers, distributors, suppliers, and retailers of building products that are incorporated into all types of residential and commercial structures and developments. We advise clients on the full range of legal issues relating to building products, including:

  • Quality control
  • Manufacturing protocols
  • Document retention
  • Warranties
  • Application instructions
  • Raw material agreements
  • Supply and distribution agreements
  • Insurance considerations
  • Compliance with consumer protection statutes
  • Claims handling
  • Litigation avoidance
  • Indemnification claims, defenses, and contract clauses
  • Statutory settlement offers and the recovery of substantial costs

In addition, our product liability practice group includes experienced trial attorneys who have handled many complex, multi-party mediations, arbitrations, and lawsuits in both federal and state court.  Miller Starr Regalia has successfully defended its clients against claims of construction defect, warranty and breach of contract claims, unfair business practices (Bus. & Prof. Code § 17200), alleged violations of the Consumer Legal Remedies Act, and fraud and misrepresentation claims. Our expertise includes pursuing claims against insurance companies on behalf of our building product clients.  We also have experience in defending against state and national class action litigation involving manufactured products used in construction applications, as well as developing settlement strategies, brokering settlements, and assisting clients in the documentation and administration of such settlements.

We believe that a diverse workforce creates a better work environment, makes us better lawyers and enables us to better serve the needs of our clients.

Diversity was instilled by our founding shareholders as a core value of the firm when Ed Regalia co-founded the Kennedy-King Memorial Scholarship Fund in 1968 in memory of Martin Luther King, Jr. and Senator Robert F. Kennedy. The Kennedy-King Memorial Scholarship Fund provides college scholarships to minority students from Contra Costa County. The firm continues to support and donate to the Kennedy-King Memorial Scholarship Fund.

Miller Starr Regalia continues to uphold the ideals of our founders and considers diversity to include individuals of differing life experiences and backgrounds, as well as protected characteristics, such as gender, race, ethnicity, religion, sexual orientation, disability and age. Our diversity goals are:

  • To foster an inclusive, congenial and professional environment that respects and values differences among our attorneys and staff and supports their professional development and advancement.
  • To recruit, develop and retain attorneys and staff of diverse backgrounds and characteristics.

The firm’s nine member Diversity Committee includes members of the firm’s Executive Committee, Hiring Committee, associates and staff. The committee meets regularly and is tasked with specific planning and monitoring efforts to keep the firm continually focused on achieving its diversity goals.
