The Insurance Coverage Group of Morrison Mahoney LLP is organized to provide seamless representation to its clients in all facets of insurance coverage advice, litigation and appeals. Partners and associates in each of our offices are called upon to respond to the most urgent issues facing the insurance industry on a national and international basis, bringing a depth and quality of experience that is unmatched by any other firm. The services that our group provides include:

  • Early Coverage Analysis and Development of Claim Resolution Strategies to respond in an effective and efficient way when claims are first presented
  • Litigating Complex Insurance Coverage Claims in state and federal courts, as well as in arbitrations and mediations
  • Monitoring and Advising Insurers with respect to high-exposure cases where coverage is being provided
  • Serving as Appellate Counsel in matters that present important and precedent-setting coverage issues
  • Drafting Insurance Policies and Procedures intended to assess current exposures and reduce the potential for future litigation

In delivering these and other services to our clients, our focus is always on defining and meeting the client’s goals in the most innovative and cost-efficient manner possible. To that end, we have recently established the capability to set up case-specific “extranet” sites and e-communities that enable our clients to have immediate access to developments in a matter on a “real time” basis. In addition, because attorneys in each of our offices are integrated into the group through technology and constant interaction, we are able to staff matters in a way that will provide the best solution for a client’s needs.

Our coverage attorneys have an extensive and distinguished record of speaking and publishing on cutting-edge coverage issues of concern to insurance professionals. In addition, Morrison Mahoney attorneys play a leading role in such important industry organizations as the Defense Research Institute, CPCU, the International Association of Defense Counsel, and the Property Loss Research Bureau.

Morrison Mahoney prides itself on the ability of its attorneys to cut across disciplines and practice areas to respond in a flexible way to the changing needs of the insurance industry. Traditionally, our Coverage Practice Group has been built around three core areas of specialization: (1) first party; (2) personal lines; and (3) complex commercial insurance disputes.

First Party (including insurance fraud)
Our first-party specialists are widely recognized for their extensive experience in advising insurers concerning all aspects of property insurance law. We have particular expertise in the investigation and litigation of fraud and mold claims. Where possible, we prefer to get involved at the early stages of a claim so that we can provide our clients with timely legal counsel during the critical period when a claim is being investigated and adjusted. Our claim resolution approach includes evaluating and providing legal opinions; assessing whether the policyholder has complied with all contract requirements; and conducting examinations under oath.

We represent property insurers in arbitration, appraisal, reference, and other non-judicial proceedings required by the policy or applicable law. Our practice group regularly represents property insurers in state and federal court proceedings on a national basis and has tried numerous complex suits arising from property losses. We have vigorously litigated and tried claims for insurance fraud.
