Alternative Dispute Resolution

For most claims, we have found that an early offer to mediate or arbitrate, after a short period of informal factual investigation, is invaluable in achieving early case resolution, or at the least, an early case evaluation that will assist in strategic planning and exposure assessment. Nelson Mullins' attorneys serve as trained and registered arbitrators and mediators with the American Arbitration Association as well as other nationally known ADR companies. These attorneys are well versed in various case resolution methodologies, including mediation, arbitration, negotiation, conciliation, fact-finding, early neutral evaluation, moderated settlement conference, mini-trials and summary jury trials. Firm attorneys have assisted in the development of corporate ADR programs for a variety of clients aimed at early and cost-effective litigation resolution in the product liability and labor and employment fields. We also have served as national and regional counsel in this area.

The Firm also regularly provides extensive pre-litigation advice and has assisted clients in avoiding litigation through proactive settlement negotiations prior to the filing of any lawsuit. We also have been involved in binding arbitrations both in the United States and internationally.
