Our Employee Benefits, Executive Compensation and ERISA Group regularly provides advice to clients on the numerous issues which arise under the Employee Retirement Income Security Act of 1974 (ERISA). These issues relate to fiduciary duty, the potential liability of employees, prohibited transactions and other areas. 

Pension funds have evolved into one of the largest sources of investment in this county. Pryor Cashman has a significant hedge fund and investment advisory practice and our Employee Benefits, Executive Compensation and ERISA Group provides valuable advice in dealing with the plan asset rules under ERISA. 

ERISA litigation is another of Pryor Cashman’s strengths. Attorneys in our Litigation Group have successfully litigated complicated ERISA matters in both the general commercial and bankruptcy contexts. We have also practiced before the U.S. Department of Labor, the Pension Benefit Guaranty Corp. and the Internal Revenue Service on matters with implications under ERISA. 

Our Employee Benefits, Executive Compensation and ERISA Group also regularly interacts with the attorneys in our Bankruptcy Group, helping to address complicated issues related to the relationship between ERISA and bankruptcy law.
