Insurance Services

RMKB has been providing services as insurer-selected counsel for insureds for more than 55 years. The Firm’s reputation for successful litigation comes from years of experience in the courtroom. The depth of experience covers virtually all areas for which insureds buy insurance protection including a whole range of torts, intellectual property, and other injuries, offenses, or wrongful acts for which insurance coverage is provided under liability insurance policies.

Representation of Insurers

In addition to defending insureds, the Firm has developed an outstanding reputation for defending insurers when they are sued for breach of contract or for extra-contractual liability exposure, including the defense of insurers in class action and unfair business practice cases.

Insurance fraud, a special problem for insurance companies, continues to plague the insurance industry. RMKB is uniquely prepared to assist insurers in the handling of these cases. The Firm’s Insurance Fraud Group is headed by a veteran of the U.S. Attorney’s Office who is well qualified to supervise this quasi-criminal specialty.

The Firm has special expertise both in the litigation of declaratory relief and bad faith actions, and all aspects of insurance coverage problems. The Firm also represents both ceding companies and reinsurers in reinsurance arbitrations and litigation.

Regulation and Reinsurance

RMKB attorneys have also represented and counseled the corporate side of insurance companies. Clients are represented at formal and informal state insurance department hearings. Representation includes multi-state licensing, regulatory and legislative liaison, and rate, rule and form filings. In addition, RMKB lawyers have undertaken an increasingly larger role in representing insurers at the administrative level before the Department of Insurance in connection with unfair claims practices allegations.

For growing companies, the Firm’s experience with company formations, mergers and acquisitions, and product development will be of special interest. RMKB also provides clients with legal representation of reinsurers and ceding companies in connection with reinsurance recoverable disputes both in litigation and arbitration, as well as the drafting and review of reinsurance treaties, security, trust and commutation agreements, and letters of credit.

Appellate Services

RMKB has had a qualified appellate department for more than 40 years. The Firm has prosecuted and defended more than 1,500 appeals in the federal and state court systems and is responsible for many of the landmark decisions in the areas of insurance and tort law. The Firm also does extensive writ work in addition to counseling insureds and insurers on the viability of appeals when an action has been handled by another law firm.

Firm Seminars For Clients

For more than 30 years the Firm has conducted annual seminars throughout the United States on significant developments in the law. These seminars consider the most significant case law and statutory developments of the past year and focus on new directions in the law and on new trends in the insurance industry.

Held in the spring each year, the California programs are presented in San Francisco, Sacramento, Los Angeles and Orange County. Since many of the Firm’s clients have offices on the East Coast, additional locations include New York and Hartford. Given the fact that Bermuda has suddenly become such an important player in the world insurance market, the Firm added a special program in Bermuda beginning in 2007. RMKB's Commitment to Diversity

 Within The Community

  • Through the firm's connection with the Los Angeles County Bar Association, several attorneys from our Los Angeles office are participating in an ongoing High School Outreach Program as volunteer mentors to Garfield High School students.
  • RMKB was the catalyst for the formation of a formal diversity program in San Mateo County and continues to work closely with the San Mateo County Bar Association to foster and encourage diversity related programs.
  • RMKB is proud to join PG&E, Union Bank of California, Wells Fargo, and others as the first and only law firm sponsor of the Bay Area Gardeners Foundation, a non-profit organization dedicated to providing financial support to economically disadvantaged students attending college.
  • RMKB is working with Sequoia High School in Redwood City in an effort to commit a team of diverse students to compete in the San Mateo County Mock Trial Program, offering to provide attorney coaches and financial assistance.
  • RMKB has been honored to sponsor an annual holiday celebration for the students at St. Elizabeth Seton School in East Palo Alto for almost two decades.  The mission of St. Elizabeth Seton School, a Vincentian Catholic School, is to educate kindergarten through eighth grade students from the multi-cultural and economically diverse populations of East Palo Alto, Palo Alto, and the surrounding communities.
