If you have turned been down for a disability claim, contact Serratelli, Schiffman & Brown P.C. for a free initial consultation.

The Social Security Disability Qualification Process

Social Security considers not only the job you did, but other possible jobs you might do. If you become disabled, you should file for benefits as soon as possible by visiting any Social Security office or going to www.socialsecurity.gov.

The process for filing a claim is long, and often takes a year or more. However, the date of the application is critical so it is best to file promptly.

How much you receive is determined by your individual work history. To be insured for Social Security disability benefits, you must have worked a certain amount of time. This is determined by the Social Security Office.

What If My Social Security Disability Claim Is Denied?

It is common to have your claim denied…don’t give up! Serratelli, Schiffman & Brown P.C. routinely assists clients in Social Security disability cases. If your initial claim has been denied, don't be discouraged. As your legal representative, we will file the necessary forms to protect your review rights.

The steps of the review process are:

  • Initial Determination
  • Reconsideration
  • Hearing
  • Appeals Council Review
  • Federal Court

You are not alone. Serratelli, Schiffman & Brown P.C. can represent you through the appeals process.

Fees

Fees for Social Security Disability, Supplemental Security Income and Veterans Assistance cases are usually handled on a contingent fee basis.

In other words, unless we are successful on your case, there are no attorney fees. There is generally no fee to answer your questions.
