With the frequent shipment of commodities, software and technology to foreign destinations, it’s more important than ever for companies to comply with the Export Administration Regulations (EAR), and U.S. Customs Regulations which govern the export and import of commercial items. The attorneys at Shipman & Goodwin have extensive experience in helping clients manage export controls and licensing matters for a diverse range of products and destinations. We provide legal counsel and strategic advice to clients to enable them to operate in compliance with the Export Administration Regulations and the International Traffic in Arms Regulations.
We advise clients on export licensing issues, including the export classification of products and technologies, review of available licensing, exception or exemption options for specific transactions and ongoing export relationships. This includes providing analysis of applicable laws and regulations and assisting clients in the required filings to obtain export licenses. We provide clients with the necessary framework to establish internal compliance programs and to develop internal procedures to help clients recognize and resolve compliance issues that they may encounter during the export functions of their business.
Attorneys at Shipman & Goodwin assist clients in the development of an Export Compliance Program, providing the required framework for the program that works with the client’s corporate structure. Shipman & Goodwin will assist its clients with the training and implementation of the compliance program and provide the required support to ensure proper rollout and use by employees of the corporate, export compliance program.
U.S. Customs and Border Protection
Shipman & Goodwin attorneys represent clients in U.S. Customs matters, including tariff classification, country of origin issues and filings related to custom’s duties. Shipman & Goodwin attorneys have successfully represented clients regarding U.S. Customs seizures of imported products.
In the event of a criminal investigation commenced by a U.S. Governmental Agency alleging a violation of Federal laws governing exports/imports or U.S. Customs, Shipman & Goodwin attorneys in the Government Investigations and White Collar Criminal Practice Group represent and ensure that the client’s interests are effectively protected at all stages of the matter.
