Shipman & Goodwin’s Bankruptcy and Creditors' Rights Group includes lawyers from the Firm’s Litigation and Business Departments. Our team represents a variety of clients, including national institutional and corporate creditors and business debtors, in bankruptcy, commercial litigation, workout and foreclosure actions. We regularly represent secured and unsecured creditors, lenders, insurance companies, franchisors, health care businesses, corporations, partnerships, equipment lessors, state and local agencies, software companies, real estate entities, retailers and suppliers in bankruptcy proceedings throughout the United States and in actions brought in the Connecticut courts. We have particular expertise in representing institutions that serve in trustee and agency roles in defaulted domestic and international project financings and debt offerings, corporations that serve as franchisors, and national health care companies.
We represent clients who take an active role on creditors’ committees and regularly negotiate plan of reorganization provisions on behalf of our clients. Our team also represents creditors in valuation of collateral hearings, classification of claims matters, and cram-down issues raised in the Chapter 11 plan process. We often represent our clients in matters brought in bankruptcy cases throughout the United States, including relief from stay proceedings, assumption and rejection of executory contract matters, and fraudulent conveyance, fraudulent transfer, and preference adversary proceedings.
Our group has represented clients in numerous high profile Chapter 11 cases and business restructurings, including those of AMR (American Airlines), Blockbuster, Chrysler, Dynegy, CIT Group, MF Global, Lehman, Delta Airlines, Enron, U.S. Airways, Calpine, Mirant, K-mart, Ames Department Stores, Frontier Airlines, St. Vincent’s Catholic Medical Center of New York, Global Crossing, LTV, Macy’s and Dow Corning.
