Immigration Law

Sullivan Ward’s immigration law practice assists businesses across the region, as well as individuals and families, to navigate the multifaceted and complex system that comprises U.S. immigration law.

Immigration attorney, Gabriel Triculescu, maintains diligent familiarity with shifting statutes and regulations, and possesses substantial experience with relevant government agencies, including the U.S. Immigration and Customs Enforcement (ICE), the U.S. Department of Labor, the U.S. Department of State, and the U.S. Department of Justice. He is fluent in Spanish, French, and Romanian, as well as in the English language.

Services for Employers

Non-immigrant Visas

We assist employers with preparing and submitting applications for a range of non-immigrant visa categories, such as:

  • E-1/2 (treaty traders/investors)
  • E-3 (Australian professionals in specialty occupations)
  • H-1B (professionals in specialty occupations)
  • H-1B1 (Chilean and Singaporean professionals in specialty occupations)
  • L-1 (intra-company transferees)
  • O (persons of extraordinary ability)
  • P (certain athletes and entertainers)
  • TN (certain Canadian and Mexican professionals)

We provide ongoing guidance regarding the limitations of specialty categories as applied to travel and assignments, senior executives, support for workers with unusual professional backgrounds, and those occupying nontraditional jobs/positions.

Permanent Residence

We possess substantial experience in assisting employers obtain Permanent Resident status (“green card”) in all relevant categories, including priority workers (EB-1), professionals with advanced degrees (EB-2), and professional, skilled, and unskilled workers (EB-3). We are extremely familiar with the PERM process, and where possible, in using alternatives to pursue legal status while avoiding formal labor certification procedures.

Support for Dependent Family Members

Sullivan Ward advises and assists dependent family members of employees during the immigration process, including preparing and filing documentation for processing, maintaining ongoing compliance with immigration requirements, and support with processing renewals, changes in status, and petitions for permanent residence.

Post-Permanent Residence Status

We assist employees with permanent residence status to retain their status when traveling outside of the United States, and provide guidance should a reentry permit be required. We also assist with applications for naturalization as U.S. citizens.

Compliance Advice

The spotlight focused on immigration issues in today’s political arena, and the consequent scrutiny by state and federal governments, compel employers to maintain strict compliance with all requirements and current law. In addition to the specific services described above, Sullivan Ward provides advice and counsel for employers to identify and address vulnerabilities in their compliance programs to avoid triggers for enforcement actions. Should the need arise, we represent clients before all state and federal agencies in investigations, as well as in civil and criminal litigation matters.

EB-5 Investor Program

We have extensive experience with the EB5 Investor Program, including regional center designations, eligibility requirements, regional center investor visas, and individual projects.

Services for Families and Individuals

For U.S. citizens and green card holders, we assist in the process of sponsoring family members for U.S. residency. As well, we represent individuals such as those in the extraordinary ability or national interest waiver category who are eligible to sponsor themselves, and those whose circumstances apply under the G-4 (Special Immigrant Retirees and Children) category.
