Construction Defect

Thorndal, Armstrong, Delk, Balkenbush & Eisinger knows complex construction defect litigation in Nevada and has been involved in its evolution for over 30 years. The firm has consistently represented developers and subcontractors since the 1970's, major participants in the MGM and Hilton Fire Litigation in the 1980's, the Pepcon Litigation in the 1990's, and since 1996 has maintained a dedicated practice group of legal professionals exclusively to the defense construction defect claims both in Northern and Southern Nevada. Since its inception the dedicated construction defect group has represented developers, general contractors, subcontractors and design professionals in thousands of claims, in every imaginable trade.

In addition to defending our clients' compliance with applicable standards and codes, our group of statewide CD attorneys continue to successfully litigate claims most recently involving the defenses of NRS Chapter 40 non-compliance, toxic mold exposure personal injury claims by owners that are erroneously included in construction defect claims, spoliation of evidence, and the construction defect related statutes of limitation and repose. We also continue to successfully litigate the issues of class certification, the specificity of NRS Chapter 40 notice and the applicability of the economic loss doctrine, all of which have recently been favorably addressed by the Nevada Supreme Court. All of the these defenses are asserted with the goal of an expeditious and cost effective resolution for the client and carrier.

The firm’s construction defect litigation team represents developers, general contractors, subcontractors and design professionals in trial, mediations, appearances before Special Masters, and in other forms of alternative dispute resolution and complex litigation scenarios. From the first required notice under NRS Chapter 40 through post trial appellate work and all phases in between, our attorneys have successfully guided clients through this complex litigation. Outside of the litigation arena, the firm is committed to educating the construction trade by means of participation in continuing education programs and serving on discussion panels within the industry, as well as through on-going lobbying efforts in the Nevada State Legislature.
