Bankruptcy & Creditors' Rights

Verrill Dana’s Bankruptcy & Creditors' Rights Group has extensive experience in all types of business bankruptcy proceedings, representing both debtors and creditors in Chapter 11 business reorganizations, Chapter 7 business liquidations, and Chapter 13 cases that involve business issues. Over the past 20 years, our bankruptcy law lawyers have represented clients in virtually every significant bankruptcy case in the District of Maine, as well as other significant filings throughout the United States, resulting in a high level of sophistication benefiting the wide range of clients we serve.

Aggressive representation of creditors’ committees, secured lenders, trade creditors, and Chapter 11 and Chapter 7 trustees in significant bankruptcy law cases is complemented by unsurpassed advocacy on behalf of shareholders, partners, directors, officers, and guarantors in matters involving bankruptcy and financial distress. Our Bankruptcy & Creditors' Rights Group also takes pride in finding creative and cost-effective legal solutions to an inclusive range of financial problems facing our clients. For businesses in financial distress, our goal is to use the various tools available to allow them to reorganize into healthy, vibrant businesses. While we always assist our debtor clients in exploring non-bankruptcy alternatives, we are skilled in using the financial restructuring tools available in the federal bankruptcy laws.

Our bankruptcy lawyers’ are regularly called on to instruct others on matters relating to financial distress and insolvency through speaking engagements, written articles, and panel representations. They are active members of the American Bankruptcy Institute, have clerked for U.S. Bankruptcy Court judges, and are recognized in leading legal directories such as “The Best Lawyers in America” and “Chambers USA: America’s Leading Lawyers for Business.” In order to ensure that our clients receive the best possible legal advice across the comprehensive range of legal disciplines, our bankruptcy lawyers collaborate with their colleagues in other Verrill Dana practice groups to solve complex problems.

Technology companies, hedge funds, hospitals, railroads, Chapter 11 and 7 trustees, creditors, committees, venture capitalists, timber companies, manufacturers, retailers, and insurance companies, are a sampling of the types of clients the Bankruptcy Law Group has served. More specifically, our Group’s lawyers represented the debtor-in-possession in the Chapter 11 case of Jackson Brook Institute (Maine’s largest psychiatric hospital). Our Group’s lawyers also represented the Chapter 11 operating trustee of the Bangor & Aroostook Railroad, a freight rail system consisting of six companies in Maine and Vermont, as well as Quebec and New Brunswick, Canada. Our Group is particularly proud of the results obtained in the JBI and B&A cases, both of which gave Verrill Dana the opportunity to showcase both the breadth and depth of legal services available to its clients. In both cases, the debtors were successfully reorganized and sold as going concerns.

Ken is a consummate professional who is thoroughly familiar with all facets of benefits work. There is no attorney I would rather have on my side if I were faced with an IRS or DOL audit.
