Probate Litigation

The lawyers in Verrill Dana's Probate Litigation Group represent individuals, fiduciaries and institutions involved in contested and uncontested matters involving trusts and estates in the probate courts and superior courts in Maine and Massachusetts. Our clients include beneficiaries, professionals or individuals serving as personal representatives or trustees or in other fiduciary positions, and charitable organizations.

The Group is also available to advise fiduciaries with respect to risk management in order to avoid litigation, and to provide services to both fiduciaries and beneficiaries, in connection with alternative dispute resolution.

The lawyers in the Probate Litigation Group, drawn from multiple related practice areas at Verrill Dana, are particularly qualified to handle these complex matters, as they have both breadth and depth of knowledge in litigation and an advanced understanding of trusts and estates. The Group's services include representation in connection with claims involving:

  • Will contests
  • Interpretation of wills and trusts
  • Fiduciary accounts
  • Breaches of fiduciary duty
  • Appointment and removal of fiduciaries
  • Successor, compromise and non-judicial settlements
  • Trust reformations to achieve tax or other goals
  • Controversies involving gift and estate tax issues

In all probate matters, Verrill Dana's Probate Litigation Lawyers combine knowledge and skill, as well as sensitivity to family matters, gained through years of practical experience.
