Antitrust & Competition

Clients seek the firm’s counsel, investigative and litigation services on a broad range of antitrust, competition and trade regulation issues. Verrill Dana’s antitrust team includes attorneys with extensive experience in private practice and with the Department of Justice’s Antitrust Division. We have represented our clients in investigations and matters brought by the Department of Justice (“DOJ”), the Federal Trade Commission (“FTC”) and state attorneys general. Our attorneys represent clients in diverse industries, including health care, manufacturing and intellectual property.

We provide legal guidance for all matters relating to antitrust and competition:

Competitor Activities: We handle litigation and provide counsel on competitive activities which include price fixing, bid rigging, boycotts, tying, monopolization, exclusive dealing and strategic alliances.

Mergers and Acquisitions: We analyze mergers, acquisitions and other transactions for potential antitrust issues and prepare required Hart-Scott-Rodino Act filings. We represent our clients in merger investigations before the FTC, DOJ and states attorneys general and in court when necessary.

Compliance, Training and Audits: We prepare, review and revise antitrust compliance policies for our clients. We also provide antitrust compliance training programs focusing on the latest antitrust trends and cases. We conduct antitrust audits to assist clients in identifying potential risks to minimize liability.

Government Investigations: We represent corporations and individuals in civil and criminal investigations by federal and state enforcement agencies, including complaints involving collusion, group boycotts, mergers and acquisitions, joint ventures and other strategic alliances, price fixing and bid rigging.

Resale Pricing and Distribution: We analyze the potential antitrust implications of customer and territorial restraints imposed by suppliers and distributors.
