Enforcement
The Firm advises clients on matters related to the enforcement of their proprietary rights. The Firm’s intellectual property litigation practice encompasses all types of trade practice claims – trademark and trade dress infringement, unfair competition, counterfeiting and unfair advertising. Firm litigators have been active in federal and state courts in a wide variety of intellectual property cases, including the successful representation of numerous clients in obtaining and defending against temporary restraining orders and preliminary and permanent injunctions in trademark, copyright and unfair competition matters, and obtaining and executing seizure orders for counterfeit merchandise.
Trademarks, Service Marks and Trade Names
We regularly counsel and represent clients in selecting and clearing trademarks and in registration of their marks, including clients in such varied industries as investment management, video games, computer software, food, entertainment, music publishing, real estate development, health care, personal services, corporate training, apparel, motor vehicles, publishing, economic development, textiles, manufacturing, advanced materials and retail services. We will coordinate trademark registrations in foreign countries, enabling our clients to protect their marks around the world.
We advise clients on the proper use and policing of their trademarks, trademark licensing, and the treatment of licenses and trademarks in connection with the formation, operation, financing and sale of businesses.
Copyright
The Firm counsels clients on a wide variety of copyright issues for many types of copyrighted materials, and assists with business transactions and disputes involving copyrightable materials. Our Firm is experienced in the area of computer software, including the negotiation and preparation of software development, procurement, licensing and consulting agreements. Our experience includes music, print, video and video game publishing and development, and the enforcement of proprietary rights in connection with copyright-protected materials.
Internet Law
The Firm prepares agreements for e-Commerce businesses and interactive Web sites, including Web hosting, development, online service and application service provider agreements, Web site use agreements and privacy policies. We advise clients on avoiding liability while conducting business online.
Trade Secrets
We advise clients in confidentiality and trade secret matters, including in employment and consulting contexts, as well as noncompetition, nondisclosure/confidentiality and invention assignment agreements and invention disclosure programs. We have handled disputes involving trade secret misappropriation and breach of confidentiality agreements.
Technology Transfer
Our attorneys have counseled clients who invent or acquire valuable technology rights in connection with the strategic management of intellectual property portfolios. This work includes the sale, acquisition and licensing of intellectual property assets, technology transfers related to mergers and acquisitions, and advising investors in technology-driven companies.
