Railroad

Wilson Elser’s Railroad practice comprises some 40 highly experienced trial attorneys who also act as counselors and advocates, helping to anticipate and prevent situations that could result in lawsuits or administrative actions. And when accidents happen, we don hard hats, safety vests and go-bags as members of our 24/7 railroad go-teams, ensuring that potentially exculpatory on-scene evidence is preserved and that maintenance and other records are promptly sequestered, inventoried, copied and shared with investigating authorities and agencies. While Wilson Elser attorneys prepare arduously for trial, we coordinate resolution strategies with our clients and use alternate dispute resolution options, including arbitration and mediation, when appropriate.

Our railroad attorneys are strongly supported by our Employment & Labor practice in the areas of employment discrimination and wrongful treatment and discharge; breach of contract; defamation; and compliance with claims under Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and the Family and Medical Leave Act. We regularly represent management in matters involving federal and state labor laws, including the Railway Labor Act, as well as grievance and arbitration proceedings.

Wilson Elser has represented national, regional and short-line railroads, rail car suppliers and related entities for many years. Our lawyers have extensive experience in handling railroad law and litigation matters, including crossing accidents, actions involving injuries to employees under the Federal Employers’ Liability Act, employment matters, right-of-way and real estate disputes, contract disputes, occupational claims, toxic tort claims and related environmental matters. We are also well-versed in Federal Railroad Safety Act federal preemption strategies and motion work.

Our attorneys routinely attend and make presentations at meetings of industry organizations. We are active members and strong supporters of the National Association of Railroad Trial Counsel and the American Short Line & Regional Railroad Association. We also attend programs presented by the Federal Railroad Administration, the National Transportation Safety Board and other agencies.
