When you are facing the end of a marriage, working with an experienced Long Island divorce lawyer can help you understand your rights and navigate New York’s divorce laws. New York allows fault-based and no-fault divorces. Most couples today choose the no-fault option by citing an “irretrievable breakdown” of the marriage for at least six months. However, fault grounds still exist and may be relevant in certain cases, including cruel and inhuman treatment, abandonment for at least one year, or adultery.

To file in New York, parties must meet residency requirements. Generally, at least one spouse must have lived in the state for a continuous year before filing and have a connection to the marriage (such as being married in New York, having lived here as a married couple, or the cause of action arising in the state). Alternatively, if both spouses are New York residents when the case begins, no minimum duration is required. These rules apply equally across Nassau County and Suffolk County.
