Biography

Anina H. Monte is a Partner at MCB where she defends physicians, hospitals, healthcare systems and academic medical centers in medical malpractice matters.

Partner Anina Monte originally developed an interest in health care law because it bridged her love of biology and human anatomy with her strong litigation skills. As she notes, most cases in this arena involve complicated medicine, and she excels at breaking down medical complexities into terms a jury can understand. This, in turn, helps her give jurors a fuller picture, including some of the finer details of a case that can sway opinions.

Anina is known for her deep appreciation of the role physicians and other health care workers play in our society, and she finds it rewarding to lend her expertise to the defense of these medical professionals when they find themselves facing unwelcome claims and allegations. From the start of each case, she works to develop a close and communicative relationship with her clients in order to ensure the highest quality of representation throughout all phases of litigation.

Her 26+ years of experience include:

•Defense of medical professionals, hospitals, nursing homes and other health care delivery systems against a broad variety of professional liability and medical malpractice allegations.
•Extensive practice throughout the New York metropolitan area, securing defense verdicts and dismissals in medical malpractice actions.
•Procurement of favorable outcomes on behalf of her clients before the supreme and appellate courts in the tri-state area, as well as in federal court.
•Negotiation of settlements in cases involving complex issues across the full spectrum of medical specialties. Particular specialties of focus include cardiology, surgery, emergency medicine, and obstetrics.
•Representation of clients before the Office of Professional Medical Conduct.
•Resolution of Medicare audit matters/recoupment attempts through non-litigious avenues.

In addition to actively defending clients, Anina spends considerable time assisting them with risk management issues. Through education and certain proactive measures, she helps clients avoid lawsuits from the outset.

Anina is rated AV Preeminent by Martindale-Hubbell, their highest rating.* She has also authored informative articles for the Firm’s Defense Practice Update client newsletter. Outside of practicing law, she devotes much of her time volunteering for her local school district.
