Biography

Brett M. Stack joined Rosenberg & Estis in 2025 and is Counsel with the firm’s Transactions Department.

Stack concentrates his practice on complex real estate transactions. He frequently represents buyers, sellers, lending institutions, sponsors, developers, landlords, tenants, condominium associations and cooperative apartment corporations with regard to their various real estate matters. Stack is well-versed in negotiating contracts, conducting closings, drafting and reviewing condominium formation documents, entity formation, as well as conducting due diligence. He represents a diverse client base to include clients who purchase and sell condominium units, cooperative units, multi-family properties, mixed-use properties and commercial properties.

Prior to joining Rosenberg & Estis, Stack was an Associate Attorney at Moritt Hock & Hamroff LLP.

Notable Work

Noho Condominium – Served as counsel representing Developer in connection with drafting Offering Plan, amendments to same, condominium formation and closing process.

Upper East Side luxury condominium, a Madison Avenue mixed-use condominium – Drafted offering plan, formed condominium and managed client on all aspects of condominium project. Assisted as co-counsel in underlying loan satisfaction and ground lease termination.

NoMad luxury condominium – Managed unit sale process for more than 100 condominium units within a new development. Drafted all offering plan amendments. Advised client on all aspects related to condominium governance. Assisted as co-counsel in underlying loan satisfaction.

Upper East Side luxury condominium, a Third Avenue mixed-use condominium – Managed unit sale process for more than 35 condominium units within a new development. Drafted all offering plan amendments. Advised client on all aspects related to condominium governance. Managed unit transfers from developer entity to individual members of developer entity.

Represented entity in refinance of $13M loan cross collateralized between 3 different cooperative apartments.

Represented joint venture in acquisition of portfolio of 100+ townhouses for approx. $477M located in Brooklyn and Queens with concurrent financing of approx. $175M from institutional lender. Client was private equity firm and controlling member of the joint venture.

Represented Purchaser of Membership Interest in LLC for approx. $4M that owns real estate in the Bahamas.

Represented high net worth individual purchasing approx. $35M cooperative unit in New York City.
