Biography

Broderick is a partner with the firm and maintains a litigation practice focused on civil liability. He is currently handling active matters in each of the practice areas listed on this page.

He is listed in this year’s edition of Best Lawyers in America in the areas of Personal Injury Litigation – Defendants; Commercial Litigation; and Medical Malpractice Law – Defendants. He has also been awarded Martindale Hubbell’s highest rating, AV Preeminent, in the areas of Tort Defense, Civil Litigation, and Defense Litigation, and has been recognized by CityView Magazine, as one of their Top Attorneys.

He has served as lead counsel in jury trials involving matters related to premises liability, breach of contract, insurance defense, employment discrimination, and personal injury. He has also tried numerous bench trials involving similar issues. In addition to his trial experience, he has represented clients in complex litigation matters involving estate litigation, business torts and professional liability.

RECENT SUCCESSES:

2024- After obtaining expert proof that our client’s tractor trailer could not have been at fault in a wrongful death case, Plaintiffs voluntarily dismissed their case.

2023- Obtained Summary Judgment on behalf of an apartment owner who had been sued for serious personal injuries alleged to have been incurred when a renter fell downstairs alleged to have been defective by Plaintiff.

2023- Obtained a judgment in defense of a property owner which was less than an Offer of Judgment made pre-trial. The low judgment resulted in costs being shifted to the Plaintiff.

2023- Successfully defended an EEOC claim on behalf of a furniture manufacturer in an alleged claim of sex discrimination and hostile work environment.

2022- Obtained a Defense Verdict as lead counsel after a multi-day jury trial on behalf of a fraternal organization in a premises liability matter. The Plaintiff was a patron who sustained severe injuries which were alleged to have been sustained in a fist fight which occurred during a social event of the organization.

2021- Obtained Summary Judgment on behalf of a property owner who had been sued for violation of an easement provision.

2020- Obtained Summary Judgment on behalf of a large housewares store in a slip and fall personal injury claim based on an alleged defective floor mat.

2020- Obtained Summary Judgment on behalf of a property owner on a claim of property damage via trespass.

2020- Obtained Summary Judgment in an errors and omissions matter on behalf of an insurance agency. The agency had been sued for alleged failure to procure insurance.

2018- Obtained Summary Judgment on behalf of a hospital in a healthcare liability claim.

2016- Obtained a six-figure Plaintiff’s Verdict as lead counsel in a multi-day jury trial on behalf of a teacher’s assistant who had been discriminated against in violation of the Americans with Disabilities Act.

The great majority of his cases involve matters based in Middle and East Tennessee, but he has also handled matters on a pro hac vice basis in other jurisdictions, including, the United States District Court for the Eastern District of Kentucky at Lexington, and the Circuit Court for Bay County, Florida. He has also appeared before the United States Court of Appeals for the Sixth Circuit.

He is active with the Hamilton Burnett American Inn of Court, which has included a term as its President. He was inducted as a fellow of the Knoxville Bar Foundation in 2019.

He has served multiple terms as a Hearing Committee Member by the Board of Professional Responsibility of the Supreme Court of Tennessee and serve as co-chair of the Judicial Committee of the Knoxville Bar Association. He also occasionally writes for the “Judicial News” column of the Knoxville Bar Association’s monthly journal.

He is also active in the Knoxville community. He has served on the Board of the Moses Teen Center of the Knoxville Boys and Girls Club, and has also served as President of the Knoxville Civitan Club.
