Biography

Kenneth J. Kutner, a trial attorney with over 24 years of experience, specializes in defending clients in construction related accidents involving alleged violations of the New York State Labor Law. Mr. Kutner has defended owners, developers, construction managers, general contractors and trade subcontractors in a broad range of construction claims including those involving scaffold falls, construction vehicle/heavy equipment accidents, electrical injuries, exposure to toxic chemicals, burn injuries, falls from heights, and fatal construction site accidents. Mr. Kutner knows how to navigate the complex issues regarding catastrophic and alleged career-ending injuries as well as contractual indemnification and insurance coverage claims. Mr. Kutner also has experience defending actions involving premises liability, lead poisoning, products liability, automobile negligence and general negligence actions. He has tried multiple cases to verdict and numerous other cases through various phases of trial in State and Federal courts. Mr. Kutner is also proactive in his approach to alternative dispute resolution and has successfully mediated and arbitrated matters during the various stages of litigation so as to minimize costs to clients.

Mr. Kutner received a Bachelor of Science degree from SUNY-Binghamton in 1986 and received his Juris Doctor from St. John’s University School of Law in 1991. He is admitted to practice in New York, Connecticut, United States Southern District, and United States Eastern District.
