Biography

Malcolm McArthur serves as a Partner in our Athens, Georgia, office and practices primarily in the areas of insurance defense litigation, employment litigation, and representation of several school districts.

He received a Bachelor of Arts in Political Science from the University of Georgia in 1970, where he was a member of Blue Key and Omicron Delta Kappa. Malcolm then graduated from the University of Georgia’s School of Law in 1973. Following graduation from law school, he was on active duty in the United States Air Force from 1974-1978 as a Judge Advocate and served as both prosecutor and defense counsel in numerous courts-martial proceedings, during which he also received the Air Force Commendation Medal in 1977. Malcolm served as an Assistant District Attorney in the Gwinnet Judicial Circuit from 1978-1980.

Education

In addition to providing general representation to the Clarke, Walton, and Oconee County School Districts, Malcolm has represented various school districts in both tort and employment litigation through their insurance carriers. This includes the Gilmer County, Putnam County, McDuffie, Stephens County, Hart County, Wilkinson County, Jackson County, and Bibb County School Districts.

General Liability

Malcolm has defended lawsuits for a variety of insurance carriers during his thirty years of specialization in insurance defense litigation. He has handled claims for the following insurers/companies: Amica Mutual Insurance Company, Liberty Mutual Insurance Company, Grange Mutual Insurance Company, Utica National Insurance Company, St. Paul Insurance Company, USF&G, Zurich Insurance Company, Southern General Insurance Company, Scottsdale Insurance Company, Aetna, GSBA Risk Management Fund, Met Life, State Farm, Southern Family Markets; Food Lion, BI-LO, Underwriters, Safety, & Claims, J.C. Penney Company, Federated Department Stores, Lord & Taylor/Associated Dry Goods, Underwriters at Lloyd’s of London, and Permanent General.

He has also defended auto liability, premises liability, false arrest / malicious prosecution, and products liability claims.

Labor & Employment

Malcolm provides advice on a variety of employment issues to the Clarke, Walton, and Oconee County School Districts. In this connection, he has handled numerous complaints filed with the EEOC and the U.S. Department of Education Office of Civil Rights by current or former employees. In addition, he has defended employment lawsuits against the Clarke County, Gilmer County, Hart County, Walton County, and Wilkinson County School Districts.
