Nathaniel James Tarvin

Nate Tarvin is a shareholder in the firm’s Irvine Office. Mr. Tarvin focuses his practice on complex civil litigation, trust and probate litigation, business litigation, shareholder derivative actions, and the defense of class actions.

Some of Mr. Tarvin’s notable trial court and appellate results include:

A defense verdict following a lengthy jury trial in a toxic tort case. The Plaintiffs’ demand was $20,000,000. The judgment was affirmed on appeal.

Summary judgment affirming a trustor’s right to unfettered discretion in the exercise of a power of appointment in a trust, notwithstanding fiduciary duties owed as a trustee. Judgment was affirmed on appeal in a published opinion clarifying the breadth of general powers of appointment. Tubbs v. Berkowitz (2020) 47 Cal.App.5th 548.

Obtained several orders either preemptively denying class certification or denying the plaintiff’s motion for class certification against consumer protection claims in the automotive and power tool industries.

Several defense judgments in commercial contract disputes.

Dismissal of a shareholder derivative lawsuit for a waiver of costs following a successful motion to appoint a receiver for the corporation and a motion to empower the receiver to act as a special litigation committee to investigate and make recommendations to the court regarding the merits of the claim.

Several dismissals of foreign corporations and individuals on the basis of a lack of personal jurisdiction in State and Federal Courts.

Several dismissals of vexatious and retaliatory strategic lawsuits against public participation (SLAPP suits) under California’s Anti-SLAPP statute, including awards of attorney’s fees.

In addition to the above, Mr. Tarvin has helped clients resolve disputes on beneficial terms in dozens of cases, often following successful motions to dismiss claims in litigation and has successfully argued multiple cases before the California Court of Appeal for the Second and Fourth Districts. He also acts as outside general counsel to local and regional businesses.
