Banking and Financial

The Banking and Finance litigation team of Cole, Scott & Kissane, P.A. works to protect lenders and guide borrowers through the financing process.  Typical transactions include secured and unsecured term and revolving loan facilities, letters of credit, syndicated loan transactions, as well as asset-based lending including equipment, flooring, accounts receivable, and inventory financing.  CSK provides representation to broker-dealers, banks, debt collectors, and other financial institutions through its wide-ranging practice areas, including: tax lien, commercial and residential mortgage foreclosure; lien disputes; banking operations litigation; consumer fraud; consumer protection defense; lending practices litigation; bankruptcy; lender liability; forfeiture;  loan repurchase litigation; insurer/loss payee disputes; mortgage warehouse lending litigation; inter-creditor disputes; property title disputes; Unfair and Deceptive Trade Practices Act; Uniform Commercial Code, Articles 3 and 4; and other state and federal common law and statutory claims.

CSK is skilled at managing and working collegially with teams, including external and internal financial analysts and economic advisors, to accomplish the client’s objectives. By understanding and utilizing the litigation process, CSK’s attorneys are keenly sensitive to settlement opportunities and are able to obtain results through settlements that in many cases are far more desirable, on a cost-benefit basis, than litigating to conclusion.
