When warranted, we may recommend the use of additional tax-saving devices such as life insurance trusts, personal residence trusts, trusts for minors, family limited partnerships and limited liability companies. Probate
Probate is the term for the court-supervised process of administration of one's estate after death. We counsel our clients who have been given the responsibility to act as Personal Representative, informing them of the necessary legal steps and assisting them in preparing the required court documents. We also advise the client regarding relevant tax issues and tax returns. We work closely with our client's own accountants or tax advisors, when appropriate. Assistance in post-death situations is also provided in situations where formal court proceedings are not required, due either to the existence of a properly executed and funded revocable living trust or a broad form of community property agreement.
Estate Litigation
Unfortunately, conflicts or disagreements sometimes arise in the context of an estate, both during life and after death during administration of a Will. Keller Rohrback attorneys are experienced in assisting clients with such disputes. We represent individuals through all aspects of litigation of such issues, including filing of complaints, discovery, deposition and trial. Where appropriate we also work with clients to reach resolution of such disputes through mediation or arbitration.
