ERISA Litigation

Verrill Dana’s ERISA Litigation Group defends employers, benefit plan fiduciaries, plan service providers, and insurance carriers against the wide variety of claims that can arise out of the administration of employee benefit plans. The group draws upon the combined depth and breadth of experience of the firm’s Employee Benefits & Executive Compensation Group and Litigation & Trial Group to provide comprehensive services through every phase of this challenging area of litigation.

Members of the group have experience counseling employers and other benefit plan parties in:

  • Disputed life, health, disability, and retirement benefit claims
  • Claims alleging breaches of fiduciary duty (including excessive fee cases)
  • Preemption of state law claims
  • Subrogation claims for health plans
  • Challenges to the “church plan” status of retirement plans maintained by churches and church affiliated organizations

Ken is a consummate professional who is thoroughly familiar with all facets of benefits work. There is no attorney I would rather have on my side if I were faced with an IRS or DOL audit.
