Legal Separation

A legal separation agreement enables married couples to negotiate the details of their split before formalizing a divorce. In some states, couples must be legally separated for a specific period of time before a divorce can be initiated or finalized. In other instances, couples may legally separate with no intention of filing for a divorce. Family law attorneys with experience handling legal separations can help negotiate the terms of a separation, including issues related to finances, property division, spousal support, child custody and child support. (To avoid conflicts of interest, each spouse should be represented by his or her own law firm.)
