Mark Bain is a Partner in Hall Booth Smith’s Montgomery office, where he focuses his practice on Medical Malpractice and Professional Malpractice & Ethics.
With nearly 30 years of litigation experience, Mark has built a reputation for providing strategic, effective defense counsel to physicians, hospitals, healthcare providers, attorneys, and other professionals facing complex liability claims.
Throughout his career, Mark has successfully defended professional liability matters in state courts across Alabama, representing clients through every stage of litigation from pre-suit investigations and discovery to trial and appeal. His extensive experience in medical and legal malpractice matters allows him to navigate highly technical cases while developing practical litigation strategies tailored to each client’s objectives.
In addition to his litigation practice, Mark has significant experience representing clients in state administrative proceedings, including Certificate of Need (CON) matters and other administrative hearings. His broad understanding of regulatory processes and professional liability issues enables him to counsel clients facing both litigation and administrative challenges.
Known for his thoughtful advocacy and client-focused approach, Mark works closely with healthcare providers, legal professionals, insurers, and businesses to minimize risk, resolve disputes efficiently, and protect their professional reputations.
Mark earned his Bachelor of Science in Commerce and Business Administration, summa cum laude, from The University of Alabama, where he majored in Corporate Finance and Investment Management. He went on to earn his Juris Doctor, cum laude, from The University of Alabama School of Law. While in law school, he was a member of the National Moot Court Team and authored The Ethics of Government Attorneys: A Victory in the Pursuit of Justice, published in the Journal of the Legal Profession.
